Renterlyst provides you with the ability to obtain electronic signatures and deliver documents to tenant-buyers, landlord-sellers, real estate professionals and other transaction participants electronically (the “E-Sign Service”). These are the terms governing this service.

Electronic Signatures and Digital Document Delivery Terms (“E-Sign Service”)

Renterlyst provides you with the ability to obtain electronic signatures and deliver documents to tenant-buyers, landlord-sellers, real estate professionals and other transaction participants electronically (the “E-Sign Service”). This service is made available to facilitate digital transactions related to rent-to-own agreements, lease-purchase documents, and other real estate-related paperwork conducted through the Renterlyst platform. When there is consent, intent to sign, and appropriate record-keeping, electronic signatures carry the same legal weight as handwritten signatures.

Use of the E-Sign Service is governed by these terms, Renterlyst's Terms of Service, and any other applicable policies. By using this feature, you acknowledge that you have read and agreed to all applicable Renterlyst terms.

Consent and Legal Compliance

By using the E-Sign Service, you represent and warrant that you have:

  • Given consent to use electronic signatures and electronic document delivery;

  • Obtained consent from the other party (e.g., applicant, tenant-buyer, or landlord-seller) to use electronic signatures and electronic document delivery;

  • Complied with all applicable laws, including the Uniform Electronic Transactions Act (UETA), the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act), and any state or local laws governing electronic transactions and disclosures;

  • Ensured that electronic documents are not used in transactions where paper signatures or wet-ink signatures are required by law.

Responsibility for Identity Verification

You are solely responsible for:

  • Authenticating and verifying the identity of all parties involved in electronic signing;

  • Ensuring that your identity verification process is documented, reliable, and compliant with applicable standards or regulations;

  • Retaining, for a period of at least seven (7) years or longer as required by applicable law, the documentation or method used to verify the identity of each signatory (e.g., government-issued ID verification or equivalent process).

Renterlyst is not responsible for verifying or authenticating the identity of any person using the E-Sign Service. You acknowledge and agree that Renterlyst’s role is solely to provide a technological interface and not to act as a party to any agreement signed via the platform.

We reserve the right to request a copy of your documented identity verification process at any time, especially in the event of a dispute, regulatory audit, or claim arising from misuse or fraud.

Document Management and Compliance

You are fully responsible for:

  • The accuracy, legality, and enforceability of any documents you upload, send, or request to be signed using the E-Sign Service;

  • Ensuring the content complies with applicable laws, local landlord/tenant regulations, and specific rent-to-own provisions where applicable;

  • Offering parties an alternative method (e.g., paper documents) upon request, and maintaining a clear opt-in and opt-out process for electronic transactions;

  • Maintaining copies of all signed documents in accordance with recordkeeping requirements under local and federal law.

Opt-Out Requests

There may be cases where Renterlyst may receive requests from applicants, tenant-buyers, or landlord-sellers to opt out of using electronic signatures or digital document delivery. If we receive such a request, we will promptly forward it to you.

However, you remain solely responsible for:

  • Responding to and complying with all opt-out requests;

  • Ensuring that parties who opt out are provided appropriate alternatives (such as paper forms or in-person signatures).

Renterlyst does not assume responsibility for managing opt-out preferences, nor does it monitor your compliance with such requests. You agree to hold Renterlyst harmless from any claims related to your handling of opt-out requests or failures to comply with legal requirements related to e-signature usage.
